                   	     ORDINANCE NO. 10234
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING BUSH ROAD
                   LOCATED NORTHEAST FROM EAST BRAINERD ROAD,
                   SOUTHEAST OF MEADOW LARK LANE, MORE
                   PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
                   CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned Bush Road located northeast from East Brainerd 
Road,
         southeast of Meadow Lark Lane, more particularly described 
herein,
         and as shown on plat attached hereto and made a part hereof by
         reference:
               
                Part of Bush Road, an unopened right-of-way some 40
                feet wide.  To find the true point of beginning of
                said part of street, start on the northeast line of
                East Brainerd Road (as now widened) 499.72 feet
                southeast of the intersection of said northeast
                line of East Brainerd Road with the northeast line
                of Meadow Lark Lane, thence northeast some 12.5
                feet with the northwest line of Bush Road to a
                point 50 feet northeast of (if measured at a right
                angle) the centerline of East Brainerd Road, the
                true point of beginning, thence continuing
                northeast some 839.2 feet with the northwest line
                of Bush Road to the southwest line of Clyde Road,
                thence southeast some 40 feet with Clyde Road to
                the southeast line of Bush Road, thence southwest
                some 841.7 feet with the southeast line of Bush
                Road to a point 50 feet northeast of (if measured
                at a right angle) the centerline of East Brainerd
                Road, thence northwest some 40 feet parallel to,
                and at all points 50 feet northeast of, the
                centerline of East Brainerd Road to the northwest
                line of Bush Road, the true point of beginning. 
                Tax Map No. 158L-G-1 and 159I-A-17.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
               
                1. The City of Chattanooga has a sewer located
                   within said right-of-way and reserves an
                   easement the width of the right-of-way for the
                   purpose of maintaining said sewer.
               
                2. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                3. All existing easements are retained.
               
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
